Legal Business Partner PACA

YOUR TASKS AND RESPONSIBILITIES
- Transversally support all the business units (Crop Science, Consumer Health, Radiology, Pharmaceuticals) as well as in the Country Platform (data privacy, litigation, compliance, corporate and M&A;) in the PACA jurisdiction (Andean : Ecuador, Colombia, Perú and Venezuela, Central América and Caribbean Countries).
- Working closely with the business’ teams, market access, group finance,
public affairs & regulatory team, and other key stakeholders, to guarantee reaching business goals in compliance with relevant laws and regulations, facilitate business continuity, protection to our license to operate, perform legal risk assessments, ensure successful processes of M&A.; Availability for international travelling in the region is expected.
- Designing legal strategies to overcome the current challenges we are facing, which comprise navigating an unstable political landscape characterized by constant and abrupt policy changes in the agriculture and healthcare sectors; competition authorities exhibiting high levels of political activity and enforcement; contradictory judicial decisions, that lead to legal uncertainty; which impacts our License to Operate.
- Managing litigation matters : This involves overseeing all litigation matters (administrative and judicial of the topics under the LPC portfolio, including collection processes, product liability, contract and third-party liability, public actions, (tutelas, acciones públicas), advertisement, consumer protection law.
The Business Partner is responsible for managing outside counsel, setting litigation strategy, and ensuring that legal proceedings are conducted cost-wise, efficiently, and effectively.
- Corporate Law : Corporate compliance of the 12 legal entities of the Group.
- Strategic and complex local matters : Antitrust topics in all business areas, including but not limited to advice on new business models, interactions with all levels of the distribution chain, the digitalization of the local business, launch of new products. Legal advice on rebate and discount schemes etc. under a commercial policy, review and advice on deviations and advice on new distribution channels.
- Obtain, update, and demonstrate strong and deep knowledge of the functional businesses assigned (business acumen and / or relevant learning appetite for Agricultural,
Pharma and Consumer Health business).
WHO YOU ARE
- Qualified, technically strong and pragmatic Attorney at Law with experience in Law Firms or multinational companies.
- Experience in Life Science Companies is desirable (Agricultural or Consumer Goods). Pharma will not be the focus.
- Native Spanish language, and advanced English skills, both written and spoken.
- Strong knowledge of the substantive law, and legal expertise in antitrust / competition law, corporate law, and commercial law.
- Strong desire to learn the Bayer Business.
- Digital mindset and effective communicator (presents arguments in a clear and convincing way).
- Sound judgment and common sense.
- Strong analytical and creative problem-solving skills.
- Flexibility to work in any of the businesses and topics at Bayer as a fluid business partner.
- High mental agility, ability to prioritize workload and operate within a fast-paced business environment.
- Ability to build relationships with stakeholders.
